EARNLEY PARISH COUNCIL MINUTES OF THE MEETING OF EARNLEY PARISH COUNCIL HELD ON THE 25th NOVEMBER 2009 COMMENCING AT 7PM
PRESENT: Cllrs Bob Norris (Chairman), Chris Bayley (Vice Chairman), Michael Karn, Michael Harrington and Lindsay Nugent.
In attendance: Mrs Louise Chater (Clerk to the Council), District Cllr Peter Clementson, County Cllr Pieter Montyn, District Cllr Grahame Barrett, Mr Duncan Thrussell (Manhood Youth Worker) and four members of the public.
66.09 PUBLIC QUESTION TIME ON MATTERS ON THE AGENDA
Mr Thrussell, advised the meeting that he was responsible for developing services and activities in the peninsula; he was based at Manhood Community College but covered the whole of the peninsula for activities for youths up to the age of 19. The Chairman asked if he was compiling a database of the number of young people in the area. Mr Thrussell advised the Chairman that a database already existed. The Chairman asked if he had considered using the facilities at the Earnley Concourse. Mr Thrussell stated he had not but there were lots of facilities locally and he would be working closely with the committee of the new community centre in Bracklesham upon its completion. The Chairman thanked Mr Thrussell for attending.
Ava Kirby expressed continuing concern about speeding along Batchmere Road and Almodington Lane.
67.09 APOLOGIES AND REASONS FOR ABSENCE
None
68.09 CHAIRMAN’S ANNOUNCEMENTS
The Chairman announced he had received a cheque in the sum of £166.23, the balance of the Pripoare Earnley Alliance Charity Account. It was noted that this money had been raised to link with a village in Romania, but contact had been lost and although extensive enquires had taken place the Council had not been able to make further contact with the group. As the money had been donated by members of the public it was considered that the money should go to another Romanian Charity – clerk to investigate the various options. CLERK
69.09 COUNTY COUNCILLOR’S REPORT Cllr Montyn advised that West Sussex County Council had announced a proposal to transfer the management of Pagham Nature Reserve to the Royal Society for the Protection of Birds.
70.09 DISTRICT COUNCILLORS’ REPORT
Cllr Barrett advised the meeting that the Local Development Framework would be presented to the full Council on 15 December 2009. It was noted that the consultation period would commence in the New Year and would end on 1st February 2010. It was noted that the paperwork would be available on the District Council website from 1st December 2009.
Cllr Barrett advised the meeting that the next meeting of the emergency planning group for the three parishes would commence at 4.30 pm at East Wittering Fire Station on 30th November 2009.
Cllr Clementson advised the meeting that a new Enforcement Policy Statement was available on the website. The Chairman asked if there would be an increase in staffing. Cllr Clementson responded that there had already been an increase in staff and considered the new strategy would be more efficient than its predecessor.

72.09 MINUTES
47.09 Amended to read Cllr Harrington on holiday.
On a proposal by Cllr Karn, it was resolved to agree and sign the minutes of the meeting held on 23rd September 2009 and this was duly completed.
73.09 MATTERS ARISING FROM THE MINUTES
46.09 The item concerning the new field entrance in Almodington Lane, close to Bookers Lane, was now closed.
56.09 It was noted that the Clerk had collected and was storing the paint.

E/09/03387/FUL Partners Of Manorfield Manorfield Residential Home Clappers Lane Earnley Chichester Variation of condition no. 4 (E/09/02990/FUL) from 24 residents to 26 residents. NO OBJECTION subject to the District Council being satisfied that plans were in place for vulnerable residents in what was considered to be a flood risk site.

NO OBJECTION subject to Chichester District Council giving consideration to the suitability of the property for listing. Cllr Karn advised the meeting that the application had been withdrawn but the Clerk was waiting for a response from Dr Wrightman, Chichester District Council Historic Building Advisor, with regard to the listing of the property.
E/09/03606/PLD Mr And Mrs McIndoe 122 Third Avenue Batchmere Chichester West Sussex Use of detached property and garage as a temporary office. NO OBJECTION
2. Applications to be considered at the meeting
E/09/03574/FUL Mr and Mrs Morgan Greenacres Studio Almodington Lane Almodington Change of use from B1 to residential use The owner had written to the Parish Council requesting a preliminary view from the Council. Cllr Karn stated that on balance the Parish Council would probably raise objections to both proposals as they did not meet planning policy requirements.
The meeting closed
The applicant advised the meeting that a flood report relating to the property had been received from the Environment Agency and two copies of the papers submitted to the District Council had been presented to the Chairman of the Parish Council.
The meeting reopened
It was agreed that these papers would be circulated but the Parish Council would not be in a position to formulate a view until in receipt of the application papers from Chichester District Council.

Cllr Karn advised that an action group had been established to compile any objections to any future application. It was noted that the action group had made contact with interested parties with the aim to make a united objection to the expected application
4. Appeals, licence applications and enforcement matters
1. 98 First Avenue, Almodington, Earnley – nothing further to report.
2. Bookers Barn Bookers Lane - The Clerk advised the meeting that Chichester District Council considered the development unauthorised and would be sending a letter to the landowner once they had been formally identified. Cllr Bayley advised the Clerk of the landowner’s details.
3. Appeal Ref: 09/00054/REF 113 Second Avenue Batchmere - It was noted that the inquiry was to be held on Tuesday 30 and Wednesday 31 March 2010 at West Sussex County Council Room 2. It was agreed that it was not necessary for a member of the Parish Council to attend this appeal.
4. Appeal Ref: 09/00088/REF Game Lodge Batchmere Road Almodington – The Clerk advised the meeting that the appeal was lodged on 11 November 2009. It was requested that the Clerk forward the Parish Council’s objection letter to the Appeal officer
5. Enforcement Notice E/15 land at 113 Second Avenue Batchmere – The Clerk advised the meeting that an enforcement notice which would take effect on 16th December 2009 had been issued and the resident had six months to comply with the notice. The resident had been ordered to discontinue use of part of the building as a dwelling, demolish the dwelling house and remove the resulting debris from the site

On a proposal by Cllr Bayley, it was resolved to make the payments and sign the cheques; this was duly completed.
c) Pension Contributions – The Clerk advised the meeting that West Sussex County Council had carried out a pension payment review and as such the Clerk’s pension payment had been re-banded. The Clerk was now required to pay 5.9% and the Parish Council 16.1% of the clerk’s annual salary into the pension fund.
d) Signing of letter and direct debit payment schedule to amend direct debit to make payment of Clerk’s salary following change of pension contribution code. On a proposal by Cllr Bayley, the letter was signed.
e) Commentary on Financial Data and Budget Proposal 2010/11, including review of clerk’s salary. The Chairman requested, in view of the confidential nature of the business about to be transacted, it was advisable in the public interest that the Press and the public be temporarily excluded and they were instructed to withdraw.
The Clerk and the Public left the meeting whilst the Parish Council discussed the options available. The Clerk returned The Parish Council resolved to increase the Parish Clerk’s hours from 30th November 2009 to 7 hours per week. It was noted that the scale point remained at scale point 18.

f) Setting of Precept Requirement – On a proposal by the Chairman, it was resolved to set the precept at £7800 for 2010/11. It was noted that this would leave a projected shortfall in the reserves of £133.00
g) Approval to attend Clerk’s Practitioners Conference 26th -27th February 2010 Stoke on Trent – The Clerk advised the meeting that the conference fees were £195.00 plus the mileage allowance. It was noted that the cost of the conference would be shared with North Mundham and the mileage allowance would be shared with North Mundham, West Itchenor and Hunston Parish Councils. On a proposal by the Chairman, it was resolved that the Clerk attend the Conference. CLERK
76.09 RISK ASSESSMENTS
On a proposal by the Chairman it was resolved to adopt the Risk Assessments and the Action Plan; this was duly completed
77.09 MANHOOD PARISHES ROAD SAFETY GROUP
Cllr Bayley advised the meeting that Tracy Webb, West Sussex County Council Highways Manager, responsible for the semi permanent SID, gave a presentation to the meeting to advise the group of the reason behind the delays in providing statistical data from various semi-permanent SID deployments on the Peninsula and the ongoing forward deployment schedules. It was noted that the data from the SID was due to be produced by the 27th November 2009. It was noted that Mobile SID training had commenced, although this Parish was not expected to have use of the SID until the New Year.
78.09 PUBLIC RIGHTS OF WAY
The Chairman reported that he was due to walk the footpaths with Kathy Eels of West Sussex County Council. Cllr Bayley advised that the work required to install the kissing gate on public footpath 49 was to take place imminently.
79.09 PONDS
There was nothing further to report.
80.09 EMERGENCY PLANNING
Cllr Nugent advised that a meeting had taken place; it was considered that the main cause of an emergency was likely to be flooding. The group was currently formulating a plan and compiling contact details of people who would be able to assist locally during an emergency.
81.09 NEIGHBOURHOOD WATCH
Cllr Nugent reported that she had attended an East Wittering Neighbourhood Management Panel meeting where the area priorities had been discussed. These had been agreed: underage drinking and beach parties, speeding throughout the peninsula, mobile phone usage whilst driving and lack of seatbelts and a crackdown on drug use and supply. It was noted that clearance work had been completed on the footpath in Bracklesham where a resident had been attacked in the summer.
82.09 SOUTH CHICHESTER LOCAL COMMITTEE
Cllr Bayley advised the meeting that at the last committee meeting there had been a long discussion to support a 30 mph speed limit through West Dean. Unfortunately, since the meeting, the initiative had been turned down by the Cabinet Member as the proposal did not meet the necessary criteria. Stockbridge Road level crossing – committee members had visited the signal box at Chichester. Concern had been raised at the length of time available for pedestrians to cross the railway lines before the gates closed. It was noted that the time difference between the lights and the gates coming down was being reviewed.
83.09 ITEMS FOR REPORTING AND INCLUSION ON FUTURE AGENDAS
1. Earnley Wildlife and Bio- Diversity Group – It was requested that this matter be placed on the Agenda in future. Meeting closed
It was noted that the hedge survey had commenced; those who attended felt it was a very useful experience but more volunteers were required. The next meeting was due to take place on 11 December 2009 at 2pm at Silvergates.

2. Freedom of Information Act Request – The Clerk advised the meeting that she had received a Freedom of Information Act request from Burley & Sons Ltd with regard to grounds maintenance contracts. The Clerk had responded within the statute time requirement advising them that the Parish Council did not have any grounds maintenance contracts.
3. The Clerk presented Cllr Michael Harrington with his Power of Well Being Certificate. It was noted that Cllr Karn was due to attend on 14th December 2009 and the Chairman and Cllr Nugent still required training.
